Agreement Summary: By using our website or services, you agree to these terms. We provide digital marketing services and you agree to use them lawfully. We own the intellectual property we create unless full payment is made. Payments are due as agreed. Either party may terminate with 30 days' notice. Indian law governs this agreement.
These Terms of Service ("Terms") govern your use of the Abitecho website and the digital marketing services provided by Abitecho ("we," "us," or "our"), a digital marketing agency based in India.
By accessing our Site, submitting an enquiry form, or engaging our Services, you ("Client," "you," or "your") agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.
These Terms, together with any Service Agreement or Statement of Work ("SOW") we enter into with you, constitute the entire agreement between us.

To enable us to provide our Services effectively, you agree to:
Delays or failures caused by your non-compliance may affect delivery timelines, for which Abitecho shall not be held liable.
Service fees are as specified in your Service Agreement or SOW. All fees are quoted in Indian Rupees (INR) unless otherwise stated and are exclusive of applicable taxes (including GST).
Payments not received within 7 days of the due date may result in suspension of Services. We reserve the right to charge interest on overdue amounts at the applicable statutory rate.
Fees paid for Services already delivered are non-refundable. For prepaid retainers, pro-rated refunds for unused periods may be considered at our discretion subject to the terms of your Service Agreement.
All intellectual property created by Abitecho prior to or independently of your engagement (including our tools, frameworks, templates, and processes) remains our exclusive property.
Upon full payment of all applicable fees, ownership of custom work product created specifically for you (such as logo designs, website code, and written content) will transfer to you as specified in your Service Agreement.
You retain ownership of all content, data, and materials you provide to us. You grant Abitecho a limited licence to use such materials solely for the purpose of providing the Services.
Unless you request otherwise in writing, Abitecho reserves the right to use completed work as portfolio examples and for marketing purposes.
Both parties agree to keep confidential any non-public business information, strategies, and data shared in the course of the engagement. Neither party shall disclose the other's confidential information to third parties without prior written consent, except as required by law.
This obligation survives termination of the engagement for a period of two (2) years.
Important: To the maximum extent permitted by applicable law, Abitecho's total liability to you for any claims arising from our Services shall not exceed the total fees paid by you to Abitecho in the three (3) months immediately preceding the event giving rise to the claim.
Abitecho shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity, whether or not we have been advised of the possibility of such damages.
Digital marketing results depend on numerous factors outside our control, including market conditions, search engine algorithm changes, competition, budget levels, and platform policy changes.
We do not guarantee specific results such as particular search rankings, a defined number of leads, specific revenue targets, or advertising performance benchmarks. Any projections we share are good-faith estimates based on industry experience and available data, not contractual commitments.
Either party may terminate the Service Agreement with 30 days' written notice. During the notice period, Services will continue and payment obligations remain in effect.
Abitecho may terminate immediately and without notice if you: (a) fail to make payment after reasonable notice, (b) engage in fraudulent or illegal activity, (c) misuse our Services, or (d) breach confidentiality obligations.
Upon termination, we will deliver all completed work and data belonging to you. All outstanding fees for work completed remain due and payable. Provisions relating to intellectual property, confidentiality, limitation of liability, and governing law survive termination.

Our Services may involve the use of third-party platforms and tools such as Google Ads, Meta, LinkedIn, email marketing platforms, and analytics tools. Your use of these platforms is subject to their respective terms of service and privacy policies.
Abitecho is not responsible for changes in third-party platform policies, pricing, or availability that may affect campaign performance or deliverables.
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or related to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts in India.
Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of our Site or Services after changes are posted constitutes acceptance of the revised Terms.
